Originally entitled “North American Free Trade Agreement,” or NAFTA, this provision of the Immigration and Nationality Act was renamed to the U.S.-Mexico-Canada Free Trade Agreement in January of 2025. It allows for the admission of Mexican and Canadian nationals who are coming to the U.S. to perform certain “professional” business active employee.

A ”Professional” is defined in U.S. Immigration law as a position that traditionally requires a minimum of a baccalaureate degree, or essentially a four-year degree. In most cases, credentials may be satisfied with a combination of education and work experience (BA plus 3 years’ experience).
