TEMPORARY CUSTODY OF U.S.-BORN CHILDREN OF DETAINED MIGRANTS

Since the end of January, 2025, ICE/ERO has been engaging in stepped-up enforcement of immigration laws. Undocumented individuals with criminal backgrounds, prior removal orders, or even those who are here without authorization have been picked up in traffic stops and sweeps by ICE, often in cooperation with local law enforcement. These undocumented migrants are usually detained immediately. Many of them have U.S.-born children.

In many instances it is advisable to put in place temporary custody documents that address the possibility that an undocumented migrant parent may be detained and/or deported from the United States. The undocumented migrant parent may designate a friend, employer, or other family member to take temporary custody of the undocumented migrant’s U.S.-born children. With execution of the proper consent forms, it is possible to prepare all the papers for a temporary custodianship of minor children in advance under Florida Statutes Chapter 751

We recommend that any undocumented migrant parent with U.S.-born children strongly consider putting in place the protections afforded by a temporary custody petition that would be filed if the parent(s) is detained or deported. Advance planning is essential for this strategy to work properly. If you are an undocumented migrant parent with U.S.-born children, you should find a suitable permanent resident or U.S. citizen person whom you trust with your children. An order of temporary custody would permit that responsible U.S. person to enroll your children in school, bring them to the doctor, authorize essential medical treatment, et cetera.

In order for this strategy to work effectively, it is essential that the consent, the Uniform Child Custody Jurisdiction Affidavit and the Petition be completed in advance of the undocumented migrant parent’s detention and/or removal (deportation), since it is very difficult to secure the parent’s consent once he or she is in ICE custody. The temporary custody may be reversed upon a Petition for Reinstatement filed by the natural parent(s).
